What's wrong with this lawyer?!-Chapter 1007 - 326: Hope the Intermediate Court Holds Firm!
Normally, a jurisdiction dispute doesn’t really involve the opposing party. It just requires the court to issue a ruling on whether the case should be handled by the current court or transferred.
However, in practice, for various reasons, some local judges handling the case may choose to communicate with the opposing party, listening to their opinions.
It’s nothing more than the fact that jurisdiction, while simple to talk about, is incredibly complicated in practice. Legal applicability is just one of many factors.
Take one previous case as an example: the defendant raised an objection to jurisdiction, and the filing court ruled to transfer the case. But then a problem arose—the receiving court refused to accept the case, claiming it should still be under the original court’s jurisdiction.
Just like that, neither of the two courts wanted the case. The defendant didn’t care, but the plaintiff was blindsided. They filed a lawsuit, and in the end, no court would take it. What would you do in this situation?
Some might think this is absurd, but lawyers who’ve handled plenty of cases are bound to have encountered situations like this.
To make matters worse, the two courts were in two different provinces. The plaintiff spent three years caught between the two courts over jurisdiction.
Forget everything else—just the time alone. Without a lawyer, who has that much time to spare?
So, how was it resolved in the end? They appealed to the Supreme Court, which designated jurisdiction.
Imagine that—just to resolve a jurisdiction issue, a case has to go all the way to the Supreme Court. What a concept!
Bear in mind, determining jurisdiction is just the first step in a case. Afterward, there’s the first trial, the appeal, execution, and a whole host of other issues.
Fast forward to the next morning at the Tengda Office. Tang Fangjing was busy at his desk, preparing for the other side’s attempt to use liability division as leverage for transferring jurisdiction. The move caught him off guard.
A strategy to hurt the enemy by a thousand points while suffering eight hundred yourself—it’s a risky play that could cause big problems if mishandled. But clearly, this time, his opponent was smooth!
While he didn’t mind traveling to Modu for litigation, staying in Jingzhou would obviously be better.
As he was preparing, the office door swung open, and Wang Qingqing walked in with a peculiar expression on her face. "Tang-ge, what’s up with my second uncle? He showed up today and took down the ’Director’s Office’ sign on the door."
Pausing for a moment, Wang Qingqing added, "Did you and Uncle Song team up to rough him up?"
Hearing this, Tang Fangjing rolled his eyes and said, "What nonsense are you spouting? What goes on in that head of yours all day? Why on earth would your Uncle Song and I gang up to beat your second uncle?"
"Clearly, it’s your second uncle having a rare pang of conscience, alright?"
Wang Qingqing rolled her eyes back, saying, "Tang-ge, your lies are so well-crafted it’s absurd. My second uncle, a pang of conscience? Only if pigs can climb trees!"
Tang Fangjing pondered briefly before saying, "Well, maybe it’s temporary… Forget it, let him do what he wants."
In truth, Tang himself was a little puzzled. Old Wang seemed to have lost his mind. Could it be that Tang really was toxic? Did everyone who got close to him start to catch some kind of affliction?
Then again, Qingqing seemed perfectly normal...
Thinking this, Tang looked up at Wang Qingqing, eyeing her clear yet foolish gaze. Alright, this girl hadn’t been normal for some time.
After all, what kind of normal person adds garlic paste to tea and insists it’s "retro style"?
Zhang Wei spends all day thinking about ways to lock people up, and Old Song practices martial arts daily, dreaming of physically battling opposing lawyers in court...
What the hell? So, in this whole office, I’m the only normal one?
Still, even if Old Wang’s behavior was strange, he was one of their own. Tang knew they’d have to ramp up efforts against Director Liu’s side. Personal grievances aside, everything else could wait.
Meanwhile, Director Liu had just learned about the vendor’s plan from Director Fang.
"Seriously? The vendor is doing that? So generous?" Director Liu asked incredulously. "They’re taking on all the responsibility themselves?"
Director Fang nodded. "Exactly. But their goal is to push for the case to be transferred. If the trial happens in Modu, it’ll be much more advantageous for them."
After thinking it over, Director Liu suddenly said, "You know, this really should be their responsibility. We’re the secondary party, and that minimum price was their decision in the first place."
"Plus, during that period, they kept sending people to audit us. As soon as they found our sale prices lower than their set minimum, they’d penalize us. So this really doesn’t have much to do with us from the start."
Suddenly, Director Liu felt his thoughts starting to click. "Honestly, you could say we’ve been carrying the blame for them this whole time!"
Director Fang smiled wryly and said, "True, but… we’re still at a disadvantage here."
"Putting that aside, we’re also one of the defendants. Since they’ve raised an objection, we should too!" Director Liu continued, "Let’s go with my line of reasoning. Get the legal department to submit a jurisdiction objection as well!"
"But what if the vendor..."
Director Liu scoffed, his face full of dissatisfaction. "We’re technically helping them here. What’s the problem? As for Tang Fangjing, I don’t know why, but whenever I see him, I feel scared..."
"So, if we can avoid taking responsibility, then avoid it!"
"Still, let’s talk to them first before proceeding."
Modu Qiangsheng Company soon received a call from the new corporation. After discussions, they decided to also raise a jurisdiction objection.
The relevant matters mentioned—vendor audits, penalties, and so on—were documents that even if not brought up by them, the other side could still find.
This was because all of it had been included in the cost administration bureau’s investigation and penalty documentation back then, listed as evidence for penalties.
So, by the next day, Old Zhou once again received a jurisdiction objection. At this point, he was already used to it.
